Seeking instructions from the government to secure their terms of service, salary, pension and other benefits, more than 25 employees of the Electricity Department moved the Chandigarh bench from the Central Administrative Court.

In a petition filed through attorney Parmod Chauhan, the employees alleged that the January 8 notification issued by the Chandigarh administration for the privatization of the Chandigarh Electricity Department, put their careers and their future at stake in the absence of any particular assurance by the government.

They demanded that instructions be given to the Respondents to secure the conditions of service and all consequential benefits provided for by the rules in force and further not to transfer their GPF and pension benefits to another fund managed and governed by a responsible other than the accountant. They also demanded the issuance of proper instructions restraining the defendants from transferring their services with the private company under the terms of service under the Punjab civil service rules. They said that there were many vacancies in the other departments of Chandigarh administration and Chandigarh engineering wing, and the candidates could be adjusted according to these vacancies.

They said that under similar circumstances, even the employees of Chandigarh Printing Press were ordered to be adjusted in the other departments of the Chandigarh/Chandigarh administration wing depending on the availability of positions and salary scales, in the event of its closure by the Government of India.

The case has been set for the next hearing on April 18.

Making a decision on staff with disabilities policy in two months: Tribunal

In a separate order, the Chandigarh Bench comprising Suresh Kumar Monga and Rakesh Kumar Gupta ordered the competent authority of the Administration to review the proposed policy for employees with disabilities in the Department of Electricity and make a decision in accordance with the law within two months. The bench issued the instructions while disposing of a request filed by employees claiming to be persons with disabilities. The petitioners claimed that without taking concrete steps to have them adjusted in other departments of the Chandigarh administration to equivalent positions, the notification of privatization of the electrical wing of the Chandigarh engineering department could not be maintained. .

The bench adopted the directions after the administration, in the response, said it was already monitoring the interests of employees with disabilities in terms of the relevant provisions under the Disability Rights Act 2016, and that the Respondents had already developed a policy and it had been submitted to the competent authority for approval.
